1. Scope
These terms govern the public website at www.mar-mac.com (the “Site”), operated under the name Marmac Living.
These terms do not govern the owner portal, bookings, guest stays, payments, or contracted HOA, property-management, rental-management, advisory, vendor, employment, or other services. Separate agreements and notices apply to those activities. Nothing in these terms waives rights that cannot legally be waived, including applicable consumer rights.
2. Informational purpose; no client relationship
The Site provides general information about Marmac Living, its experience, service categories, and areas served. It is not a binding proposal, quotation, guarantee, public offer, or commitment to provide services.
Submitting a form, sending a message, using WhatsApp, or discussing a possible engagement does not create a client, fiduciary, agency, brokerage, advisory, property-management, or other professional relationship. A service relationship begins only through an appropriate written agreement. Service scope, fees, taxes, authority, availability, response times, exclusions, cancellation, and responsibility will be governed by that agreement.
3. No professional or investment advice
Site content is not legal, tax, accounting, engineering, architectural, insurance, securities, investment, or other licensed professional advice. References to property, fractional or co-ownership structures, rental performance, budgets, capital, market conditions, or potential outcomes are general and illustrative—not an offer or recommendation to buy, sell, finance, or invest. Obtain advice from appropriately qualified professionals for your circumstances.
4. Property and operating risks
Property, inspection, storm-preparation, security, maintenance, and off-grid content describes general practices and risk-reduction measures, not warranties. No inspection, maintenance program, monitoring system, vendor oversight, or storm-preparation step can guarantee prevention or detection of damage, theft, equipment failure, utility interruption, weather effects, access problems, or other loss. Any actual commitment must be stated in a signed service agreement.
5. Accuracy, experience, and pricing
We aim to keep Site information clear and current, but laws, taxes, permits, markets, technology, vendor availability, prices, and property conditions can change. Verify information before relying on it for a decision.
Unless expressly stated otherwise, references to combined experience, prior portfolios, doors or units, markets, or projects describe the principals' work before Marmac Living's launch or through other organizations. They are background credentials, not Marmac operating results or guarantees.
Any prices, ranges, commissions, percentages, budgets, or packages shown are preliminary or illustrative unless expressly identified as a binding offer. Final pricing and applicable IVA, costs, and exclusions will be stated in a written agreement.
6. Acceptable use and intellectual property
Use the Site only for lawful personal or internal business evaluation. Do not interfere with security, attempt unauthorized access, submit malicious or false material, impersonate another person, or use Marmac content or branding in a way that implies unauthorized affiliation or endorsement.
Site text, design, photographs, graphics, branding, and downloadable materials belong to Marmac Living or are used with permission. You may save reasonable excerpts to evaluate our services, but no commercial reuse or other license is granted without written permission.
7. Third-party links, privacy, and availability
The Site may link to WhatsApp, the owner portal, social networks, or other third-party services. Those parties control their own content, security, privacy, fees, and terms. A link does not necessarily constitute endorsement.
Our Privacy Notice and Cookie Policy describe how website data are processed. We may update, suspend, or discontinue Site content or functions. We do not guarantee uninterrupted or error-free operation.
8. Responsibility
To the maximum extent permitted by law, Marmac Living is not responsible for decisions made solely from general Site content, third-party content, or unauthorized or unlawful Site use. We do not exclude liability where exclusion is prohibited by law, including mandatory privacy or consumer obligations. A signed service agreement will govern responsibility for the relevant service.
9. Law, changes, and contact
These terms are governed by the applicable laws of Mexico and Baja California Sur, without depriving consumers of mandatory protections or remedies available through PROFECO. We may update these terms prospectively by posting the revised version and date on the Site.
